1. Who we are
The CreamyPeach platform, available at creamypeach.com and its related applications and services (the Platform), is operated by PEACHCREAM S.R.L., a limited liability company organised under the laws of Romania, with its registered office at Șoseaua Iancului nr. 53, bl. 102B, sc. C, et. 7, ap. 111, Sector 2, Bucharest, Romania, registered with the Bucharest Trade Register under no. J2026041854006 (EUID ROONRC.J2026041854006), sole registration code (CUI) 55048995, registered for VAT purposes in Romania under VAT identification number RO55048995, which is also our identification number for the EU One Stop Shop (OSS), main activity NACE 6391 (web portals) (CreamyPeach, we, us, our). Our VAT identification number appears on every receipt.
CreamyPeach is the seller of record for every purchase made on the Platform. Your contract for any Subscription, Wallet deposit, unlock, tip or other paid feature is with CreamyPeach alone. Creators are not parties to that contract.
Contact: [email protected] (support and complaints); [email protected] (payments and refunds); [email protected] (data protection); [email protected] (legal notices and copyright); [email protected] (security reports); [email protected] (point of contact under the Digital Services Act). Post: the registered office above.
2. Acceptance of these Terms
These Terms of Service (the Terms) are a binding contract between you and CreamyPeach. They govern your access to and use of the Platform as a visitor, registered user, subscriber, purchaser or Wallet user (you, User, Fan).
You accept these Terms by ticking the box marked "I have read and agree to the Terms of Service" when you create an Account, and each time you confirm a purchase. Acceptance given in this way is a valid electronic contract under Article 1178 of the Romanian Civil Code, Law no. 365/2002 on electronic commerce and Regulation (EU) No 910/2014. We record the date, time, version accepted, your account identifier and network address, and we send you a copy of the accepted Terms by email.
If you do not agree to these Terms, do not use the Platform. If you become ineligible, or your use becomes unlawful where you are, you must stop using the Platform.
If you use the Platform as a Creator, the Creator Agreement applies to you in addition to these Terms and prevails for Creator matters.
3. Documents that form part of these Terms
The following documents are incorporated into these Terms and are published on the Platform: the Privacy Policy; the Cookie Policy; the Acceptable Use Policy (which restates and supplements the Content Standards in Annex B); the Complaints, Takedown and Appeals Policy (which supplements clauses 37–39); the Refund and Cancellation Policy (which supplements clauses 23–24 and Annex A); the Identity and Age Verification Policy; the Content Moderation Policy; the Anti-Human Trafficking and Exploitation Policy; the 18 U.S.C. § 2257 Compliance and Exemption Statement; and the checkout disclosures shown for each transaction. Where a standalone policy is more specific than, or stricter than, a clause of these Terms on the same subject, the policy applies to that subject.
If a checkout disclosure is more specific than a general clause, the disclosure governs that transaction. If any term conflicts with a mandatory law that cannot be waived, the law prevails to the minimum extent necessary and the rest of the Terms continue to apply.

5. Interpretation
"Including" means "including without limitation". Headings do not affect meaning. References to laws include their amendments. The singular includes the plural. Nothing in these Terms excludes or limits rights you have under mandatory consumer, data protection, payment or digital-content law.
6. Adults only
The Platform is strictly for adults. You may use it only if you have reached the Age of Majority and are legally permitted to access adult content where you are located.
If you have not reached the Age of Majority, you must leave the Platform immediately and must not create an Account, view Content, subscribe, deposit, message or unlock anything. Access by minors is prohibited even if it is technically possible, a payment method is available or another person gives permission.
You must not create an Account for a minor or allow a minor to use your Account, device, email or payment method to access the Platform.
7. Age verification
Before you can view adult Content, subscribe, deposit into your Wallet or interact with any Creator or Virtual Creator, CreamyPeach verifies that you are an adult through the Verification Provider. Depending on your country, verification may use a government identity document and a facial check, a payment-card check or another method accepted by the law of your country. CreamyPeach receives only the result of the check, the method and the date. The Verification Provider handles your documents under its own privacy notice, which is shown to you before you start. The methods available in your country, and the standard we apply, are described in the Identity and Age Verification Policy.
We apply age verification in every country where we offer the Platform, and we apply the specific method required by local law, including in the United Kingdom under the Online Safety Act 2023 and in United States states that require age verification for adult websites.
We may require re-verification where risk signals, law, our Payment Processor or a competent authority require it. We may deny access where we cannot reasonably confirm that you are an adult or where you refuse verification.
You must not bypass age gates, use false information, use another person's identity or payment method, or use any other means to evade age verification.
8. Restricted jurisdictions
You are responsible for determining whether accessing adult content is lawful where you are located.
We restrict access from countries, regions, networks or payment methods where adult content, AI-generated adult content or our payment processing is unlawful or creates legal, sanctions or processor risk. The Platform is not offered to persons in countries subject to comprehensive sanctions of the European Union, the United Nations, the United States or the United Kingdom, or to persons on sanctions lists.
You must not use VPNs, proxies, false billing locations or other means to evade geographic, legal or age-verification restrictions. Access may be refused even if the website loads where you are.
9. Nature of the Platform
CreamyPeach is an online adult entertainment service. It provides access to Content and interactive features (subscriptions, paid messages, pay-per-view, tips, custom content and AI-assisted chat) supplied by independent Creators and by CreamyPeach's own Virtual Creators.
The Platform supplies digital content and digital services only. It does not provide physical goods, offline meetings, escort services, prostitution, dating services, physical companionship or any real-world sexual service, and it does not arrange, facilitate or permit any of these.
Interactions on the Platform are entertainment. They do not create a romantic, dating, employment, agency, fiduciary, therapeutic or advisory relationship with any Creator, Virtual Creator or CreamyPeach. Affectionate, flirtatious or fantasy language is part of the entertainment and is not a promise or an offer of anything outside the Platform.
The Platform is not a source of legal, medical, financial, psychological, relationship or sexual-health advice.
10. Creators and Virtual Creators
Creators. Some profiles are operated by independent Creators: adults who have verified their identity and age with CreamyPeach through the Verification Provider and who license their Content to CreamyPeach under the Creator Agreement. Creators are independent contractors. They are not employees or agents of CreamyPeach and are not parties to your contract with CreamyPeach. Every payment you make is made to CreamyPeach; CreamyPeach pays Creators separately through its payout providers. You never pay a Creator directly, and a Creator may never ask you to.
What a Creator can see about you. A Creator can see your username, whether you subscribe to that Creator, and your purchases, tips and messages relating to that Creator's profile. A Creator cannot see your legal name, email address, payment details, age-verification data or your activity on other profiles.
Virtual Creators. Other profiles are Virtual Creators operated by CreamyPeach. A Virtual Creator is a fictional persona whose images and media are created with AI; it does not correspond to any real person. Its messages are either generated by AI, in which case the conversation carries the AI notice described in clause 11, or written by members of the CreamyPeach team who operate the persona. In both cases the profile is labelled as a Virtual Creator, and nothing a Virtual Creator says is a statement about a real person's life, location or feelings.
AI tools. Creators may use AI tools provided by CreamyPeach, including the AI Studio, to generate and edit images, video and short-form clips, to build consistent AI personas and to respond to messages through an AI Chat Assistant. Virtual Creators are operated through AI. Content produced with the AI Studio is subject to the Content Standards, is screened before publication and is labelled under clause 11, which also explains how you are told.
Creator conduct. Creators are bound by the Content Standards. If a Creator asks you to pay outside the Platform, to meet in person, or to do anything prohibited by these Terms, report it to [email protected]. We may add, remove or retire Creator and Virtual Creator profiles at any time, subject to clause 47.
11. AI disclosures
CreamyPeach uses artificial intelligence for some Content and features: to generate and edit Content where a Creator chooses to use the AI Studio, to operate Virtual Creators, to power the AI Chat Assistants that Creators enable, to recommend Content, and to moderate the Platform. Content and conversations are not AI-generated unless they are labelled as such; everything else is written by people: the verified Creator or a person the Creator has authorised to help with messages, or, for a Virtual Creator, the CreamyPeach team operating that fictional persona.
Chat. A conversation with a Creator is with that Creator, or with a person the Creator has authorised under the Creator Agreement to help manage their messages, unless the Creator has enabled an AI Chat Assistant, in which case the Platform tells you so no later than your first interaction in that conversation, through a persistent notice in the chat interface that stays visible for as long as the assistant is active. A conversation with a Virtual Creator is with a fictional persona operated by CreamyPeach: when its replies are generated by AI the same notice is shown, and when they are written by the CreamyPeach team the profile label still tells you that the persona is not a real person. An AI Chat Assistant will confirm that it is automated if you ask.
Media. AI-generated and AI-modified images, video and audio are labelled as artificially generated, and generated media is marked in a machine-readable form where the technology allows, as required by Regulation (EU) 2024/1689 (the AI Act). Virtual Creator profiles are labelled as AI-generated, and so is Content that Creators produce with the AI Studio.
Limits. AI outputs may be inaccurate, fictional, repetitive, delayed or inappropriate. We review, filter and may regenerate or remove AI outputs, but we do not guarantee that every output is reviewed by a human. AI outputs are not advice and must not be relied on.
You must not remove, obscure or alter AI labels, watermarks, metadata or disclosures, and you must not use AI features to request content prohibited by the Content Standards.
AI personas. An AI persona, whether a Virtual Creator or a persona a Creator builds with the AI Studio, is not a real person unless it is a verified Creator's own likeness used with that Creator's consent. No Content on the Platform may use the likeness, voice or name of any other real person, and we remove and, where the law requires, report Content that does.
Entertainment only. AI Chat Assistants and Virtual Creators are entertainment. They are not a substitute for human relationships or for medical, psychological, legal or financial advice, and they do not monitor your wellbeing. If you are in distress, contact your local emergency services or a helpline. We may point you to support resources and may limit or end conversations that raise safety concerns.
12. Your Account
You need an Account to subscribe, deposit, message or unlock Content. Registration requires an email address, a password, confirmation that you are an adult, your country, and acceptance of these Terms and the Privacy Policy. Age verification under clause 7 follows before any adult Content is shown.
You must provide accurate, current information and keep it updated. You must not provide a false age, identity, country or payment information.
You may hold one Account. You must not create additional Accounts to evade restrictions, abuse promotions, bypass limits or avoid enforcement. We may link, restrict or close Accounts operated by the same person for those purposes.
You are responsible for everything done through your Account. Keep your password and devices secure, use two-factor authentication where offered, and tell us at once at [email protected] if you suspect unauthorised access. You must not share, sell, lend or transfer your Account.
Where ownership of an Account is disputed, we decide on the basis of the registered email address, verification records, login history and payment records. We may lock the Account while we investigate.
You may close your Account at any time in Account settings. Clause 59 explains what happens to your Wallet balance and your data.
13. Licence to use the Platform
Subject to these Terms, CreamyPeach grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for lawful personal adult entertainment.
This licence does not transfer ownership of any Content, software, database, AI system, persona, brand or other intellectual property.
14. Licence to view Content
When you subscribe to, unlock or receive Content, you receive only a limited, personal, non-transferable right to view it on the Platform while you have access to it. You do not acquire copyright, publicity rights, download rights, resale rights or any commercial right.
You must not download, copy, screen-record, screenshot for distribution, reproduce, publish, sell, share, mirror, index or archive Content, and you must not use Content, in whole or in part, to train, fine-tune or evaluate any AI model. Content is protected by watermarks and forensic identifiers; we investigate unauthorised distribution and may pursue it.
A Subscription gives access to the subscriber feed described on the profile page. It does not unlock Pay-Per-View or paid messages unless the profile page says so. A PPV or message unlock applies only to the item shown at purchase.
Content may expire, be removed or be replaced by the Creator or by CreamyPeach for rights, legal, safety or moderation reasons. We do not promise that any item remains available permanently. If an item you paid for becomes unavailable through our fault or the Creator's fault before you have had reasonable opportunity to view it, we refund the price or credit your Wallet; clause 23.3 applies.
15. Electronic communications
You agree that we may send legal notices, receipts, renewal notices, security alerts and policy updates by email to your registered address and through your Account dashboard. A notice is received on the business day after it is sent by email, or when you next log in for dashboard notices, whichever is earlier. Keep your email address current.
16. Prices, currency and tax
Prices are shown in US dollars (USD). The price, any tax due, the total you will pay, the billing interval for Subscriptions and the cancellation method are shown on the checkout page before you confirm. Review the checkout page before you pay.
VAT. If you are located in the European Union, VAT at the rate of your country is added to the price and shown as a separate line before you confirm. CreamyPeach is registered for VAT in Romania and for the EU One Stop Shop; it collects that VAT and pays it to the competent tax authority, in Romania directly and in other EU member states through the One Stop Shop. Your location is determined from your billing country, the country of your payment card and your network address, as EU VAT law requires. If you are located outside the European Union, no VAT is added and the price shown is the final price, unless the law of your country requires us to collect a VAT, sales or similar tax there (clause 72). If a tax becomes chargeable on your Subscription after you subscribed, we notify you before the first renewal that includes it, and you may cancel before that renewal.
Your bank or card issuer may apply its own exchange rate and fees, which are outside our control.
Discounts. Where we announce a price reduction, we show the lowest price applied in the 30 days before the reduction, as required by law.
We may correct a transaction affected by an obvious pricing or technical error. If we do, we tell you and you may cancel the transaction for a full refund.
We do not personalise prices on the basis of automated decision-making. Differences in the total you pay reflect only the taxes of your country.
17. Payment and billing descriptor
Payments are processed by our Payment Processor under its own terms and privacy notice, which are shown at checkout. By submitting payment details you authorise the Payment Processor to charge your payment method for the total shown, and for the recurring amount of any Subscription until you cancel.
Your card or bank statement will show the billing descriptor displayed at checkout and on your receipt, with a reference to the transaction. The descriptor may be the name of our Payment Processor rather than "CreamyPeach"; a descriptor that differs from our brand does not mean the charge is unauthorised. If you do not recognise a charge, check your receipts and your Account transaction history, then write to [email protected] before contacting your bank.
CreamyPeach does not store full payment card numbers. Card data is handled by our Payment Processor under PCI DSS.
A payment may be declined, delayed or reviewed by the Payment Processor or by us for fraud, risk, sanctions or compliance reasons. Purchases are confirmed only when the payment is captured and recorded in your Account.
18. Subscriptions and automatic renewal
A Subscription gives access to the subscriber feed of one Creator or Virtual Creator for the period shown at checkout (for example one month, six months or twelve months).
Automatic renewal. Unless the checkout page states that the Subscription is non-recurring, it renews automatically at the end of each period, at the price shown at checkout, until you cancel. By subscribing you authorise recurring charges to your payment method for that amount plus applicable tax.
Reminders. We email you a confirmation when you subscribe, a receipt after each renewal with a cancellation link, and, for any Subscription with a period longer than one month, a reminder at least seven days before renewal.
Cancellation. You may cancel at any time in Account settings, as easily as you subscribed, or by writing to [email protected]. Cancellation stops future renewals; you keep access until the end of the period already paid. Cancellation does not refund the current period, except under clause 24.
Price changes. If the price of your Subscription changes, we email you at least 30 days before the new price takes effect. If you do not cancel before then, the new price applies from the next renewal. You may cancel at any time before the change.
If a Creator leaves the Platform or a profile is removed during a paid period, your Subscription ends on the day access ends and we refund the unused part of the period to your Wallet or, if you ask, to your payment method.
19. Wallet
You may deposit money with CreamyPeach into a prepaid Wallet and spend the balance on pay-per-view content, paid messages, tips and custom content. The deposit amount, any tax due and the total are shown before you confirm.
What the Wallet is. The Wallet is a prepayment for CreamyPeach's digital services. The balance is held by CreamyPeach as seller of those services. It is not money, electronic money, a deposit, a security, a gift card or a gambling instrument. It earns no interest, cannot be transferred to another person and cannot be withdrawn as cash, except where clause 24.4 or the law requires a refund.
Tax. VAT, if you are in the EU, or any tax due under clause 72, is charged when you deposit, at the rate of your country, and shown separately. No further tax is charged when you spend the balance.
Spending. Balance is spent when you confirm an unlock, send a paid message, send a tip or confirm a custom-content request. The price is shown before each confirmation. Your dashboard shows a ledger of every deposit, spend, refund and adjustment.
Balance never expires. Purchased balance does not expire and is not forfeited while your Account is open. Promotional balance we grant free of charge may carry an expiry date, which we show when we grant it, and is spent before purchased balance.
Auto-refill is not enabled unless you switch it on in Account settings. If you do, we show the trigger amount, the refill amount and how to switch it off before you confirm, and we email you after each refill.
If a deposit is reversed, refunded or charged back, or was made with a stolen payment method, we remove the corresponding balance and may remove access to Content bought with it.
20. Pay-per-view and paid messages
The unlock price and a description of the item are shown before you confirm. Once you confirm, the item is delivered to your Account immediately and the purchase is final under clause 24.2.
Paid messages are delivered when they appear in your conversation. A paid conversation does not guarantee a reply from a specific person or within a specific time, and may be answered by an AI Chat Assistant under clause 11.
21. Tips
A tip is a voluntary payment. It is delivered immediately and is final once sent. A tip does not oblige anyone to create content, reply, meet you or do anything else, and you must not use tips to request anything prohibited by the Content Standards.
Tips are limited per transaction and per day. The limits are shown in Account settings.
22. Custom content
Where a Creator offers custom content, you describe what you want, the Creator quotes a price and a delivery time, and you confirm. The amount is taken from your Wallet and held by CreamyPeach.
The Creator may decline any request. Requests for anything prohibited by the Content Standards are declined automatically and may lead to enforcement under clause 42.
When the content is delivered to your Account, you have seven days to report that it does not match your confirmed request. If you do not report within seven days, the purchase is final. If the Creator does not deliver within the quoted time plus seven days, the amount is returned to your Wallet automatically.
Custom content is licensed to you under clause 14. It remains the Creator's property.
Custom Content may be produced with the AI Studio and is then labelled as AI-generated. You may not request Custom Content that depicts any real person, including yourself, unless that person is a verified Creator who has consented to it. Requests for anything prohibited by the Content Standards lead to enforcement under clause 42.
23. Refunds
Because the Platform supplies digital content and digital services that are delivered immediately, a purchase is final once the Content has been delivered to your Account, the Subscription period has started, the tip has been sent or the Wallet balance has been spent, except as stated in clause 24 (right of withdrawal) and in this clause.
We refund in full, to your original payment method, where: you were charged twice for the same item; a Subscription renewed after you cancelled it in time; an item was not delivered because of a fault on our side; or your Account was used without your authorisation and you reported it promptly.
Where an item you paid for becomes unavailable through our fault before you had reasonable opportunity to view it, or Custom Content is not delivered, we refund the price to your Wallet or, if you ask, to your payment method.
Dissatisfaction with Content, a change of mind, not using purchased access, or not reading the checkout disclosures is not a ground for a refund, except where the law provides otherwise.
Conformity. If you are a consumer in the EU, you have the statutory rights under OUG 141/2021 (Directive (EU) 2019/770) where digital content or a digital service does not conform to the contract: to have it brought into conformity, or a proportionate price reduction, or termination with a refund. Nothing in these Terms limits those rights.
To request a refund, write to [email protected] with your account email, the transaction reference, the date and amount, and the reason. We answer within 14 days and pay approved refunds within 14 days of approval.
24. Right of withdrawal for consumers (EU, EEA and UK)
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you have the right to withdraw from a distance contract within 14 days without giving a reason, under OUG 34/2014 (Directive 2011/83/EU) and, in the UK, the Consumer Contracts Regulations 2013. The 14 days run from the day you conclude the contract. This clause explains how the right applies to each purchase.
Digital content delivered immediately (pay-per-view, paid messages, custom content). Before you confirm, the checkout asks you to tick a box stating: "I request immediate delivery and I acknowledge that I lose my right of withdrawal once delivery begins." If you tick it, delivery starts immediately and the right of withdrawal is lost for that purchase. If you do not tick it, we do not deliver the item until 14 days have passed, and you may withdraw at any time before then for a full refund. We confirm your consent and acknowledgement by email after each purchase.
Subscriptions. Before you confirm, the checkout asks you to tick a box requesting immediate access. You may still withdraw within 14 days of your first payment by writing to [email protected] or using the form in Annex A. If you do, we refund the price less a proportionate amount for the days of access you have had. After 14 days, the Subscription continues until you cancel under clause 18.4, and renewals are not subject to a new withdrawal period.
Wallet deposits. You may withdraw from a Wallet deposit within 14 days of making it and receive a refund of the part of that deposit you have not spent. Balance you have spent is final under clause 24.2. Refunds are paid to the payment method used for the deposit, within 14 days of your withdrawal.
Tips are performed in full at the moment you send them, at your express request, and are final.
To withdraw, send a clear statement to [email protected], or use the model form in Annex A. You may also use any other unequivocal statement. You do not need to give a reason. We acknowledge every withdrawal by email.
This clause does not limit any other right you have under mandatory consumer law.
25. Billing errors
If you believe you were charged in error, did not receive an item, could not cancel or were charged after cancelling, write to [email protected] with the details in clause 23.6. We review the payment, delivery and cancellation records and reply within 14 days.
You must not seek the same refund from CreamyPeach and from your bank at the same time without telling us.
26. Chargebacks
A chargeback is a dispute raised with your bank or card issuer. Please contact [email protected] first; most billing problems are resolved within days, and a chargeback takes weeks. Contacting us first does not limit your right to dispute a charge.
If a charge is disputed, we may suspend the related access and Wallet balance while the dispute is open. If the dispute is decided in our favour and you received the item, we may close your Account.
We respond to chargebacks with evidence of acceptance, delivery and account activity (clause 55). Where a chargeback was raised in bad faith for a purchase you received, we may recover the amount reversed and the processor's chargeback fee, and we may report the matter to the Payment Processor. We do not charge any fee for a chargeback raised in good faith.
27. Fraud prevention and limits
We use automated and manual risk controls, including device and network signals, velocity limits, transaction limits and the Payment Processor's fraud tools, to protect you, Creators and the Platform.
We may limit deposit amounts, spending frequency, tips, message volume and payment methods, and may delay a transaction or a refund while we or the Payment Processor investigate. We tell you when a limit applies to your Account.
You must not use stolen payment methods, fake identities, bots, emulators, disposable identities, false refund claims or chargeback schemes. Doing so leads to immediate closure of your Account and may be reported to the authorities.
28. Not a bank, e-money or investment service
CreamyPeach is an adult entertainment platform. It is not a bank, credit institution, payment institution, electronic money institution, money transmitter, investment service or gambling operator, and it is not authorised as any of these. The Wallet is a prepayment for our own services and nothing else.
29. Your conduct
You must use the Platform lawfully and in accordance with the Content Standards in Annex B. You must not harass, threaten, extort, stalk, dox, blackmail, impersonate, defraud or abuse any person, Creator, Account or system.
You must not use the Platform to request, arrange or pay for illegal services, real-world sexual services, meetings, trafficking or coercion, or to launder money.
In messages and custom-content requests, you must not request anything that the Content Standards prohibit. Prohibited requests are refused, may be removed, and may lead to enforcement under clause 42 and to reporting under clause 31.
30. Prohibited content and requests
The Content Standards (Annex B) list what is absolutely prohibited (Part A), prohibited (Part B) and required (Part C). They apply to everything you post, send, request or upload, including profile text, messages, prompts and custom-content requests, and to coded language, emojis, misspellings and indirect references used to evade them.
31. Zero tolerance: minors, exploitation and non-consensual content
CreamyPeach has zero tolerance for any sexual or sexualised depiction of a person under 18, real or fictional, including AI-generated, drawn or role-played depictions and any attempt to present an adult as a minor; for child sexual abuse material; for sexual exploitation, trafficking and coercion; and for intimate content of a real person made or shared without that person's consent, including deepfakes.
A breach leads to immediate permanent closure of the Account, preservation of evidence and reporting to the competent authorities, including the Romanian Police and the National Center for Missing and Exploited Children (NCMEC) where applicable, and cooperation with law enforcement as permitted or required by law.
Non-consensual intimate content. If you believe that Content depicts you or another real person in an intimate or sexual manner without consent, report it through the in-platform report tool or to [email protected] with the location of the Content and your connection to it. We restrict access to the Content while we assess the report, normally within 24 hours, and remove it where the report is substantiated. We may use proportionate identity checks to prevent fraudulent takedowns. Removal does not prevent us from preserving evidence where the law requires.
Deepfakes and impersonation. You must not request, create, upload or distribute Content that depicts a real, identifiable person through face-swapping, voice cloning or any other synthetic technique, whether or not that person has consented, or Content that impersonates any real person. The only exception is a verified Creator's AI persona of their own likeness created under the Creator Agreement and labelled as AI-generated. Virtual Creators are fictional and must not be used to suggest that a real private person is involved.
Report suspected minors, exploitation, trafficking or non-consensual content immediately to [email protected]. If anyone is in immediate danger, contact local emergency services; the Platform is not an emergency service.
32. No off-platform payments or circumvention
You must not pay, offer to pay or be asked to pay any Creator or Virtual Creator outside the Platform for Content or interactions offered on the Platform, by any means (payment links, cryptocurrency, gift cards, bank transfers, cash apps or otherwise). You must not use links, handles, QR codes or contact details to move paid activity off the Platform.
This rule protects you from fraud, ensures age verification and tax compliance, and is required by our Payment Processor. Breach leads to enforcement under clause 42. Interactions outside the Platform are at your own risk and are not covered by these Terms.
33. Intellectual property
The Platform, its software, design, databases, AI systems, Virtual Creators, brand and trade marks belong to CreamyPeach and its licensors. Content supplied by Creators belongs to the Creators and is licensed to CreamyPeach. Nothing you pay for transfers ownership of any of these.
You must not remove watermarks, metadata, rights-management information, AI labels or access controls; must not reverse-engineer, scrape, crawl, index or bulk-download the Platform or its Content; must not bypass paywalls, signed URLs, rate limits or anti-bot systems; and must not use any Content or data from the Platform to train, fine-tune or evaluate AI models.
Your submissions. You keep ownership of messages, requests and other material you submit. You grant CreamyPeach a non-exclusive, worldwide licence to store, display, transmit, moderate, reproduce and use your submissions as needed to operate the Platform, provide support, enforce these Terms, detect abuse and comply with law. You confirm that your submissions do not infringe anyone's rights. Feedback and suggestions may be used by CreamyPeach without obligation.
You must not submit another person's personal data, images, voice or private communications without authority.
34. Copyright and rights complaints
CreamyPeach respects intellectual property. If you believe Content on the Platform infringes your copyright or other rights, send a notice to [email protected] with the subject "Rights Complaint" containing: identification of the protected work; the URL or location of the infringing Content; your name, address and email; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorised to act; and your physical or electronic signature. This procedure satisfies 17 U.S.C. §512 (DMCA) and Article 16 of Regulation (EU) 2022/2065.
We remove or disable access to Content identified in a complete notice promptly, notify the person who posted it with a copy of the notice, and allow a counter-notice. Where a valid counter-notice is received and the complainant does not start proceedings within 10 business days, we may restore the Content. Repeat infringers are terminated.
False or bad-faith complaints are prohibited and may result in liability to the affected person and enforcement under clause 42.
35. Reporting content and conduct
Every item of Content and every conversation has a report tool. You may also report by email to [email protected]. A report should identify the Content or conduct, the reason, and, where you choose to give it, your name and email. Reports are handled under clause 36.
36. Notice and action for illegal content
CreamyPeach is a hosting service under Regulation (EU) 2022/2065 (the Digital Services Act). Anyone may notify us of Content they consider illegal through the report tool on each item, or by email to [email protected]. A notice should contain: an explanation of why the Content is illegal; the exact URL or location; the name and email of the person submitting it (optional for content involving sexual abuse of minors); and a statement that the notice is accurate and complete.
We acknowledge receipt, assess every notice diligently and without undue delay, and decide whether to remove or disable access to the Content. We tell the person who submitted the notice of our decision and how to contest it. Where we rely on automated tools to assess a notice, we say so.
Where we become aware of Content giving rise to a suspicion that a criminal offence involving a threat to life or safety has been or will be committed, we inform the competent law-enforcement authorities.
37. Statement of reasons
When we remove or restrict Content, demote it, suspend or close an Account, or restrict payments or messaging, we give the affected person a clear and specific statement of reasons on a durable medium, stating: the facts and circumstances relied on; whether the decision was based on a notice or on our own investigation; whether automated means were used; the provision of these Terms or the law on which the decision rests; and how to contest it. We do not give reasons where the law prohibits it or where disclosure would obstruct a criminal investigation.
Decisions are also reported to the European Commission's DSA Transparency Database where the law requires.
38. Complaints and appeals
You may complain, free of charge, about any decision we take under clauses 36, 37 or 42, about a refund decision, or about any other aspect of our service, through the complaint tool in your Account or by email to [email protected]. Complaints about moderation decisions may be submitted for six months after the decision.
We acknowledge a complaint within 24 hours and give you a reasoned decision within seven business days, or within two business days where the complaint concerns suspected involvement of a minor, non-consensual content, bestiality or human trafficking; in those cases the content concerned is disabled immediately on triage pending our decision. Complaints are reviewed by a person who was not involved in the original decision. Where the complaint shows that the decision was unjustified, we reverse it without undue delay. Complaints are never decided solely by automated means.
Out-of-court dispute settlement. If you disagree with our decision on a complaint about Content or Account moderation, you may refer the dispute to a dispute settlement body certified under Article 21 of the Digital Services Act in your member state. We engage in good faith with the certified body and are bound by its procedure. This does not affect your right to go to court.
We may refuse to process complaints that are manifestly unfounded, abusive or repeated after a final decision, and we tell you why.
39. Points of contact under the Digital Services Act
Our single point of contact for the authorities of EU member states, the European Commission and the European Board for Digital Services is [email protected]. Communication is accepted in English and Romanian.
Our single point of contact for users is [email protected] and the complaint tool in your Account. These channels allow direct communication with a person; they are not fully automated.
Romania's Digital Services Coordinator is the National Authority for Management and Regulation in Communications (ANCOM). We publish a report on our content moderation activity at least once a year.
40. Content moderation
Content is screened by automated tools (including classifiers, hash-matching against known illegal material, and keyword and image filters), and every image, video, audio file, post, profile element and Pay-Per-View item is reviewed by a trained human reviewer before publication. Messages are filtered automatically in real time and reviewed by a person where flagged, reported, sampled or required by law.
Moderation decisions are based on these Terms, the Content Standards, the law, the rules of our Payment Processor and payment networks, and safety risk. We test our automated tools for accuracy and bias and keep human review for significant decisions.
41. Measures against misuse
Users who frequently provide manifestly illegal content, or who frequently submit manifestly unfounded notices or complaints, are warned and may then be suspended for a reasonable period. We assess the number of items or notices, their proportion to the user's total activity, their gravity and the user's intent, and we give a statement of reasons under clause 37 before any suspension.
42. Restriction, suspension and closure of your Account
By you. You may close your Account at any time in Account settings. Clause 59 applies to your balance and data.
Immediate closure. We close your Account immediately, without warning, if you breach clause 31 (zero tolerance), use a stolen payment method or commit fraud, or if we are required to by law, a court, a competent authority or the Payment Processor on compliance grounds.
Other breaches. For any other breach of these Terms we first warn you and, where the breach can be remedied, give you a reasonable time to remedy it. If the breach continues or is repeated, we may restrict features (messaging, deposits, purchases), suspend your Account for a stated period, or close it. We give a statement of reasons under clause 37 in every case.
Suspension pending investigation. We may suspend an Account, or specific features, while we investigate a suspected breach, a chargeback, a report or a security incident. A suspension lasts no longer than the investigation requires and is reviewed at least every 14 days.
Consequences. On closure for breach under clauses 42.2 or 42.3, access to Content ends immediately. Purchased Wallet balance is refunded to your payment method within 30 days, less any amount we are entitled to recover under clause 26.3, unless the law or a competent authority requires us to hold it. On closure by you or for any other reason, clause 59 applies.
You may appeal any decision under this clause through clause 38.
43. Privacy
How we process your personal data is explained in the Privacy Policy, which forms part of these Terms. In summary: we are the controller; age-verification documents are processed by our Verification Provider; payments are processed by our Payment Processor; private messages may be processed by AI providers to generate replies and are reviewed by people only where flagged, reported or sampled for quality; Creators see the limited information in clause 10.2; and we never use your adult-content interests for advertising.
You must not collect, expose, sell or misuse personal information about any other person on the Platform.
44. Law enforcement and legal process
We cooperate with law-enforcement authorities, courts, regulators and child-safety organisations where the law permits or requires. We disclose personal data in response to valid legal process, to protect life or physical safety, to investigate child sexual abuse, trafficking, non-consensual intimate content or fraud, and to establish or defend legal claims. We review each request for authority and scope and challenge requests that are unlawful or disproportionate. We notify you of a disclosure where the law permits and it would not compromise an investigation or a person's safety.
We may preserve Content, messages, Wallet records, acceptance records and device data under a legal hold where they are relevant to a dispute, investigation, chargeback or authority request. During a hold, deletion or export of the held records may be delayed.
45. Sanctions
You confirm that you are not a person or entity on any sanctions list of the European Union, the United Nations, the United States or the United Kingdom, and that you are not located in a country subject to comprehensive sanctions. We may block accounts, transactions, payment methods or networks where sanctions, anti-money-laundering rules or the Payment Processor's rules require.
46. Availability
We aim to provide a reliable service but do not guarantee uninterrupted, error-free or permanent availability. The Platform may be interrupted for maintenance, security incidents, infrastructure or processor failures, legal requirements or events beyond our control. You are responsible for your own device, browser and connection.
If a paid Subscription is unavailable for more than 48 consecutive hours through our fault, we extend the period or credit your Wallet proportionately on request.
47. Changes to the service
We may add, change, remove or discontinue features, Virtual Creators, AI systems, payment methods and interfaces, and may carry out maintenance, security updates and migrations.
Where a change to a Subscription or to the Wallet materially reduces what you paid for, we notify you at least 30 days in advance by email, explain the change, and allow you to terminate the affected Subscription with a proportionate refund of the unused period, as required by OUG 141/2021. Minor changes that do not reduce functionality need no notice.
Beta or experimental features may be unstable, limited or withdrawn at any time, and are marked as such.
48. Disclaimers
The Platform is provided for adult entertainment. Virtual Creators, AI Chat Assistants and Content are fiction and fantasy; they do not promise meetings, relationships, exclusivity, emotional commitment or any real-world outcome. AI outputs may be inaccurate or inappropriate and are not advice.
We apply reasonable technical measures, including watermarking and download restrictions, to protect Content, but no measure prevents all unauthorised copying, and we are not liable for the acts of other users or third parties.
Nothing in this clause limits your statutory rights as a consumer under OUG 141/2021 or equivalent law, including the right to digital content and digital services that conform to the contract.
49. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence (Article 1355 of the Romanian Civil Code), for breach of your statutory consumer rights, or for any liability that cannot be excluded or limited by law.
Subject to clause 49.1, we are not liable for loss of profit, loss of business, loss of data or indirect or consequential loss, and our total liability to you for all claims arising in any 12-month period is limited to the greater of the total amount you paid to CreamyPeach in the 12 months before the event giving rise to the claim and USD 500.
We are not liable for the acts or omissions of Creators, other users, the Payment Processor, the Verification Provider or other third parties, except to the extent they act as our processors or subcontractors and the law makes us responsible.
50. Your responsibility for unlawful conduct
To the extent permitted by consumer law, you are responsible for losses, costs and claims that CreamyPeach suffers as a direct result of your unlawful conduct on the Platform, including uploading or requesting illegal content, infringing another person's rights, using a stolen payment method, raising a chargeback in bad faith for a purchase you received, or circumventing our security. This clause does not apply to ordinary use of the Platform or to good-faith disputes.
51. Governing law and courts
These Terms are governed by the laws of Romania.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer laws of the country where you habitually reside (Article 6 of Regulation (EC) No 593/2008), and you may bring proceedings against CreamyPeach in the courts of that country as well as in Romania (Article 18 of Regulation (EU) No 1215/2012). CreamyPeach may bring proceedings against a consumer only in the courts of the consumer's country of residence.
For users who are not consumers, the courts of Bucharest, Romania have exclusive jurisdiction.
We do not require consumers in the European Union, the European Economic Area or the United Kingdom to use arbitration and we do not impose class-action waivers on them. If you reside in the United States, clause 73 applies to you.
52. Consumer complaints and alternative dispute resolution
Please contact [email protected] first. We acknowledge complaints within 24 hours and answer them within seven business days (clause 38).
Consumers may use alternative dispute resolution. The competent body for CreamyPeach in Romania is the Alternative Dispute Resolution Directorate of the National Authority for Consumer Protection (ANPC – Direcția de Soluționare Alternativă a Litigiilor), Bulevardul Aviatorilor nr. 72, Sector 1, Bucharest, Romania, anpc.ro/ce-este-sal. Consumers may also complain to ANPC at anpc.ro, or to the consumer authority of their own country. ADR is voluntary for both parties and does not affect your right to go to court.
Consumers in the United Kingdom may complain to Citizens Advice or use a certified ADR provider; consumers in the United States may contact their state attorney general or consumer protection office.
53. Changes to these Terms
We may change these Terms for the following reasons: changes in law or regulation; requirements of our Payment Processor, payment networks or a competent authority; security or fraud prevention; changes to the features of the Platform; and clarification. We will not change the price of a Subscription you already hold except under clause 18.5.
We notify you of changes at least 15 days before they take effect, by email and in your Account dashboard, with a summary of what changed and the new version. Changes required by law or to address a security or safety risk may take effect sooner, and we explain why.
If you do not accept a change, you may close your Account before the change takes effect, and we refund your unspent purchased Wallet balance and the unused part of any Subscription period. If you continue to use the Platform after the change takes effect, the new Terms apply to you.
Changes never apply retroactively to purchases already made. Every version carries a version number and effective date, and we keep previous versions available on request.
54. Assignment
We may transfer our rights and obligations under these Terms to a successor to the business of the Platform, and we notify you if we do; your rights are not reduced by a transfer. You may not transfer your Account or your rights under these Terms.
55. Electronic records
We keep electronic records of your acceptance of these Terms, checkout confirmations, withdrawal consents, transactions, deliveries, cancellations and support communications. These records are admissible as evidence of their content. Keep your own receipts and cancellation confirmations.
56. Severability, waiver and survival
If any provision is held invalid or unenforceable, it is limited to the minimum extent necessary and the rest of the Terms continue. Our failure to enforce a provision is not a waiver. Provisions that by their nature should survive (intellectual property, payment obligations, liability, dispute resolution, records) survive termination.
57. Language
These Terms are published in English and in Romanian. For consumers in Romania, the Romanian version prevails. For everyone else, the English version prevails over any translation we provide for convenience. The contract is concluded in the language in which you accept these Terms.
58. How a contract is concluded on the Platform
As required by Law no. 365/2002: (a) you select the Subscription, deposit amount or item and reach the checkout page; (b) the checkout page shows the price, any tax due, the total, the renewal terms where applicable and the withdrawal consent; (c) you can correct any input before confirming; (d) you confirm by clicking the button marked "Pay now" (or equivalent) and ticking the required boxes; (e) we send you a confirmation email with the details of the purchase and a copy of these Terms; (f) the contract is concluded when we send that confirmation. We store the contract and your acceptance records and provide them to you on request to [email protected].
59. Closing your Account, dormant Accounts and your balance
Closing. When you close your Account, Subscriptions end at the end of the current paid period, access to Content ends, and your unspent purchased Wallet balance is refunded to your original payment method within 30 days on request to [email protected]. If you do not request a refund, we hold the balance for 24 months and refund it on request at any time during that period. Promotional balance lapses on closure.
Data. We delete or anonymise your personal data as described in the Privacy Policy. We retain transaction, invoice, acceptance and chargeback records for the periods the law requires.
Dormant Accounts. If you have not logged in or made a purchase for 24 months, we email you twice, 30 days apart. If you do not respond, we close the Account and apply clause 59.1 to your balance. Purchased balance is never forfeited.
60. Accessibility and contact
We are committed to making the Platform accessible in accordance with Law no. 232/2022 (the European Accessibility Act). Our accessibility statement is published on the Platform. If you have difficulty using any part of the Platform, write to [email protected].
All contact details are in clause 1.3. We may update contact methods by publishing them on the Platform's legal page.
These Terms, the documents in clause 3 and the checkout disclosures are the entire agreement between you and CreamyPeach about the Platform. No statement by a Creator, Virtual Creator, AI Chat Assistant or support agent changes these Terms.
61. Force majeure
Neither you nor we are liable for failure or delay in performing an obligation, other than an obligation to pay money, caused by an event beyond reasonable control, including failure of the Payment Processor, a payment network or a bank, action of a competent authority, change in law, cyber-attack, failure of telecommunications, hosting or power, epidemic, war or natural disaster. The affected party must notify the other and use reasonable efforts to resume performance. Where a force majeure event prevents us from providing a paid Subscription for more than 14 days, you may terminate it and receive a proportionate refund.
62. Attachments and content you send
You may send text and, where the feature allows, images in conversations and custom-content requests. Everything you send is subject to the Content Standards and is screened by the moderation tools in clause 40. You must not send content depicting any person other than yourself without that person's consent, and you must never send sexual content depicting a minor, which is reported under clause 31.
You confirm that you own or have the right to send anything you upload, and you grant the licence in clause 33.3. A Creator or Virtual Creator is not obliged to view, respond to or keep anything you send, and we may delete attachments after the retention period in the Privacy Policy.
63. Protecting Creators
Creators are entitled to the same protection as you. You must not attempt to identify a Creator's legal name, address, workplace, family or location; must not contact a Creator outside the Platform using information obtained on it; must not follow, visit, stalk or threaten a Creator; and must not publish, sell or share a Creator's real identity or any Content or message outside the Platform.
You acquire no right to use a Creator's name, image, likeness or persona, or the name, image or persona of a Virtual Creator, outside the Platform, including on social media, in advertising, in AI prompts, or to create derivative content.
Breach of this clause results in immediate closure of your Account and may be reported to the authorities. We provide Creators with the evidence they need to pursue civil or criminal remedies against a user who leaks their Content or endangers their safety.
64. Forensic watermarking and enforcement
Content delivered to you carries visible and invisible forensic identifiers that may encode your account identifier, the time of delivery and the item. If Content you received appears outside the Platform, these identifiers allow us and the Creator to trace the source. By receiving Content you acknowledge this and consent to the identifiers being used as evidence.
Where we identify that Content was leaked from your Account, we close the Account, revoke all access without refund of the price of the leaked items, and may pursue, or assist the Creator in pursuing, civil remedies for the loss caused (including the lost licence value of the Content and the cost of enforcement) and criminal complaints under Law no. 8/1996 on copyright and the Criminal Code. We may share your account and delivery records with the Creator and with the authorities for that purpose.
65. Payment methods and use on behalf of others
You confirm that every payment method you use is yours or that you are expressly authorised by its holder to use it for adult-content purchases, and that the funds are lawfully yours. Using another person's card, a corporate card without authority, or funds derived from crime is fraud under clause 27.3.
Your Account is for your personal use. You must not use the Platform on behalf of another person, an agency, a business or a group, and must not purchase content for redistribution to others.
66. Blocking
You may block any Creator or Virtual Creator, and a Creator may block you, in each case without giving a reason. Blocking ends the conversation and future purchases between you; it does not refund amounts already paid, and a Subscription continues to the end of the paid period unless you cancel it. A block is not a moderation decision and cannot be appealed.
67. Promotions and referrals
Promotions, trials, discounts, promotional Wallet balance and referral rewards are subject to the terms shown when they are offered, including eligibility, duration, the price after a trial and how to cancel. Where a trial converts to a paid Subscription, we show the trial length, the price after it and the cancellation method before you start, and we email you at least three days before the first charge. One promotion per person; benefits obtained through duplicate Accounts, false identities, bots or abuse are reversed.
68. Third-party links and services
The Platform may contain links to the Payment Processor, the Verification Provider and other third-party services, each governed by its own terms and privacy notice. We are not responsible for their content or practices. Creators are prohibited from posting links that take you off the Platform for paid interactions; if you follow one, you do so at your own risk and outside these Terms.
69. Our right to refuse service
We may refuse to open an Account, or to accept a particular transaction, where age or identity verification fails, where the Payment Processor declines, where sanctions, fraud or legal risk applies, or where a person has previously been closed for breach. We never refuse service on the basis of race, ethnicity, religion, disability, sex, sexual orientation or gender identity. Where we refuse, we tell you the main reason unless the law prevents us.
70. Live streams
Where live streaming is offered, a stream is a digital service performed at the time of broadcast. The price, duration and rules are shown before you join. By joining a paid stream you request immediate performance under clause 24.3 and the price is final once the stream starts. Streams are moderated in real time under clause 40, and a stream may be ended at any time for breach of the Content Standards. Streams may not be recorded by you.
71. Notices and language of communications
Notices to us must be sent to the addresses in clause 1.3 in English or Romanian. Notices to you are sent to your registered email address and your Account dashboard. Support is provided in English and Romanian; where we offer support in another language, the English text of any communication prevails.
72. Taxes outside the European Union
No EU VAT is charged to customers located outside the European Union. In countries outside the EU where the law requires us to charge a sales, consumption or digital-services tax on purchases by consumers located there, that tax is added to the price and shown before you pay, and we remit it to the competent authority. Where no such tax applies, you pay the price shown. You are responsible for any tax that your own law imposes on you as a purchaser.
73. Dispute resolution for users in the United States
Scope. This clause applies if you reside in the United States. It is governed by the Federal Arbitration Act and covers any dispute, claim or controversy between you and CreamyPeach arising out of or relating to these Terms, the Platform or your Account, including their formation, enforceability and interpretation, whether in contract, tort, statute or otherwise.
Talk to us first. Before starting arbitration or a court claim, you must send a written notice of dispute to [email protected] describing the problem and the relief you want, and we must do the same to your Account email. If the dispute is not resolved within 60 days of the notice, either party may proceed. Limitation periods are paused during that period.
Binding individual arbitration. Any dispute not resolved informally is resolved by binding arbitration before a single arbitrator administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The arbitrator may award the same relief that a court could award to the individual party and must apply these Terms as a court would. Hearings take place by videoconference or in the county where you reside, at your choice. Fees are allocated as the Consumer Arbitration Rules provide; if your claim is for USD 10,000 or less and is not frivolous, CreamyPeach pays all AAA filing, administrative and arbitrator fees above USD 200. Judgment on the award may be entered in any court of competent jurisdiction.
Class action and jury waiver. You and CreamyPeach each waive the right to a jury trial and the right to bring or take part in a class, collective, consolidated, private attorney general or representative action. The arbitrator may not consolidate the claims of different users or award relief to anyone other than the individual party, except public injunctive relief where the law requires it. If this waiver is found unenforceable for a particular claim, that claim proceeds in court and is stayed until the arbitrable claims are resolved.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may ask a court for injunctive relief to stop unauthorised use or abuse of the Platform, infringement of intellectual property or a breach of the Content Standards.
Mass arbitration. If 25 or more demands raising similar issues are filed with the help of the same or coordinated counsel, the demands are administered in batches of 50, each with its own arbitrator and fees, starting with 10 demands selected by each side as bellwethers. The remaining demands are stayed, and limitation periods are tolled, until the bellwether batches are decided. A court may enforce this clause and, where needed, appoint a process arbitrator.
Opt-out. You may opt out of clauses 73.3 to 73.6 by emailing [email protected] within 30 days of first accepting these Terms, from the email address of your Account, with the subject "Arbitration opt-out". Opting out does not affect any other part of these Terms.
Changes and survival. Changes to this clause do not apply to a dispute of which either party has already given notice. This clause survives closure of your Account. Nothing in it prevents you from reporting a concern to a government agency.
74. Recommendations and ranking
The Platform suggests Creators and Content on the home feed, in search results and in messages. The main parameters are: the Creators you subscribe to or follow; your interactions on the Platform (views, purchases, tips, messages and time spent); the recency and popularity of Content; the settings each Creator applies to who may see an item; the preferences and blocks you set; and safety filters that exclude restricted or unverified Content. Paid placement, where we offer it, is labelled as sponsored.
You can influence what you are shown by following or unsubscribing, hiding Creators or Content, blocking, and adjusting the content preferences in Account settings, including, where available, an option to order your feed by recency alone. This clause provides the information required by Article 27 of Regulation (EU) 2022/2065.
75. General
Except for Creators, who may rely on clauses 63 and 64, no person other than you and CreamyPeach has rights under these Terms.
Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and CreamyPeach, or between you and any Creator.
Headings are for convenience only. If we provide a translation of these Terms, clause 57 applies.

B. Content Standards (Acceptable Use Policy)
These Content Standards apply to everyone on the Platform: Fans, Creators and CreamyPeach's own Virtual Creators. They apply to Content, profile text, messages, prompts, custom-content requests and anything else posted, sent or requested, and to coded language, emojis, misspellings and indirect references used to evade them. A breach of Part A results in immediate permanent closure of the Account and may be reported to the authorities. A breach of Part B results in removal of the Content and, depending on seriousness and repetition, a warning, suspension or closure under clause 42.
Part A — Absolutely prohibited
Any sexual or sexualised depiction of a person under 18, real or fictional, photographic, drawn, animated or AI-generated, and any content that presents an adult as a minor through age statements, styling, props, settings, language or role-play.
Any depiction of sexual activity that is non-consensual or presented as non-consensual, including simulated rape, coercion, blackmail, drugging or sexual activity with a person who is asleep, unconscious, intoxicated or otherwise unable to consent.
Any sexual depiction of a real, identifiable person who has not given written consent, including edited, face-swapped, voice-cloned or AI-generated material, and any content obtained by hidden camera, hacking or without the knowledge of the person depicted.
Any content that involves, promotes or results from human trafficking, sexual exploitation, prostitution arranged through the Platform, or the abuse of a person in a position of vulnerability.
Bestiality, necrophilia, and sexual content involving excrement.
Content that incites or depicts serious violence or terrorism, or glorifies either.
Part B — Prohibited
Content that presents sexual activity between family members, including role-play that uses family terms to that effect.
Sexual content involving weapons, blood, injury, strangulation, asphyxiation or the use of illegal drugs.
Sexual content filmed in a public place where it is unlawful, or that shows bystanders who have not consented.
Soliciting or arranging in-person sexual services, meetings or escorting, whether through content, profile text or messages.
Content that infringes a third party's intellectual property rights, including commercial music, film or television excerpts, logos, and content copied from other creators or platforms without a licence.
Hate speech, harassment, threats, doxxing, and content that discriminates on the basis of race, ethnicity, religion, disability, sex, sexual orientation or gender identity.
Content that advertises or sells illegal goods or services, gambling or financial products, or that solicits payment outside the Platform.
Spam, malware, deceptive links, and content designed to manipulate the Platform's ranking or payment systems.
Content that discloses another person's personal data without consent.
Part C — Required practices (Creators and CreamyPeach)
Documentation proving that every person depicted was an adult and consented is held before upload, under the Creator Agreement.
AI-generated or AI-modified content is marked as such on upload, and the Platform labels it to Fans. AI-generated content is never presented as a real recording, and an AI-generated persona is never presented as a real person's body or likeness.
Content produced with the AI Studio uses only reference material the Creator is entitled to use: the Creator's own verified likeness or fully synthetic personas. No other real person's face, body, voice or name is used, even with that person's consent.
Watermarks and technical protection measures are not removed or obscured.
Adult content is shown only to verified adults who have subscribed or paid, with the warnings the Platform displays, in accordance with Law no. 196/2003.
Profile information is truthful about age, the nature of content offered and the use of an AI Chat Assistant.
Part D — Review and appeals
Content is screened by automated systems and reviewed by trained human moderators before publication; messages are screened automatically and reviewed where flagged, reported or sampled. Decisions are notified with reasons under clause 37 and may be contested under clause 38. The report tool on every item is available to Fans and to third parties.
C. Records-keeping compliance statement
In compliance with the records-keeping requirements of 18 U.S.C. §2257 and 28 C.F.R. Part 75, and with Romanian Law no. 196/2003, CreamyPeach states as follows.
Every real person depicted in sexually explicit content on the Platform was at least 18 years old at the time the content was produced. Each Creator who uploads such content holds, and makes available to CreamyPeach on request, a copy of a government-issued identity document for every person depicted and a signed consent and release, under the Creator Agreement.
Content produced by CreamyPeach's Virtual Creators is computer-generated and depicts no real person.
CreamyPeach is not the primary producer of Creator content. Records required to be maintained by primary producers are maintained by the respective Creator. For content for which CreamyPeach is the producer, records are maintained by the Custodian of Records below.
Custodian of Records: PEACHCREAM S.R.L., Șoseaua Iancului nr. 53, bl. 102B, sc. C, et. 7, ap. 111, Sector 2, Bucharest, Romania. Requests concerning records may be sent to [email protected].
Age verification of every user who accesses adult content is performed through our Verification Provider before access is granted, as described in clause 7.
