18 U.S.C. §2257 Record-Keeping Compliance Statement

This statement is made by PEACHCREAM S.R.L., Șoseaua Iancului nr. 53, bl. 102B, sc. C, et. 7, ap. 111, Sector 2, Bucharest, Romania, Trade Register no. J2026041854006, CUI 55048995 (CreamyPeach), the owner and operator of creamypeach.com and its related applications and services (the Platform).

All persons are adults. Every real person who appears in any visual depiction of actual or simulated sexually explicit conduct available on the Platform was at least eighteen (18) years of age at the time the depiction was created. CreamyPeach has zero tolerance for any sexual depiction of a minor, real or apparent, and reports any such material to the National Center for Missing and Exploited Children and to the Romanian Police.

CreamyPeach is not the producer of Creator content. Content uploaded by independent Creators is created by those Creators, at their own premises and under their own direction. CreamyPeach provides the hosting, storage, formatting, transmission and sale of that content and is therefore exempt from the definition of "producer" under 18 U.S.C. §2257(h)(2)(B)(v) and 28 C.F.R. §75.1(c)(4). The records required by §2257 for Creator content are created and maintained by the respective Creator as the primary producer, and each Creator certifies in the Creator Agreement that those records exist for every person depicted before the content is uploaded.

Custodian of Records. For any visual depiction for which CreamyPeach is itself the producer, and for the age, identity and consent documentation that CreamyPeach collects from Creators under the Creator Agreement, the records are kept by the Custodian of Records at the following address, where they are available for inspection as the law requires:

Creator content. For every real person who appears in sexually explicit content uploaded by a Creator, the Creator holds, and must provide to CreamyPeach within 48 hours of request, a copy of a valid government-issued photo identity document showing the person's date of birth, a signed consent and release covering the creation of the content and its distribution and sale on the Platform, and a dated record of production. Content in which only the Creator appears is covered by the Creator's own identity verification, which every Creator completes through our verification provider before any content can be published. Creators must keep these records for at least seven years after the content was last available on the Platform.

Virtual Creators and AI-generated content. Profiles labelled as Virtual Creators are operated by CreamyPeach and consist entirely of computer-generated imagery. No real person is depicted in that content, and no real person's likeness is used to produce it. Content that a Creator produces with the Platform's AI Studio either depicts no real person or depicts only the Creator's own verified likeness with the Creator's explicit consent; it is labelled as AI-generated. The record-keeping requirements of §2257 do not apply to depictions in which no actual person appears; where a Creator's own likeness is used, the Creator's verification record applies.

Date of this statement. This statement applies to all content available on the Platform from the date on which the Platform first became commercially available to the public, which is the date on which these records began to be kept. No sexually explicit content was published on the Platform before that date.

Content produced outside the United States. Most Creator content is produced outside the United States by Creators who are not subject to §2257. CreamyPeach nevertheless requires the same age, identity and consent documentation from every Creator worldwide, so that the standard of proof of age is the same for all content on the Platform.

What we hold. For each Creator: the identity-verification result, the verified legal name, date of birth and the document type, issued by our verification provider; the Creator's certification for each upload that every person depicted is an adult who has consented; and, where we have requested them, copies of the identity documents and releases of other persons depicted. Records are indexed by Creator account, by upload and by the name and any alias of each person depicted, so that any depiction can be matched to its records.

Security. Records are stored in encrypted form, separately from the content itself, with access limited to the Custodian of Records and named compliance staff, and every access is logged. They are retained for seven years after the content was last available on the Platform, or longer where an investigation or legal hold requires.

Inspection. The Custodian of Records makes the records available for inspection by competent authorities in accordance with 28 C.F.R. §75.5 and with Romanian law, during business hours at the address above, on reasonable notice. Requests from payment networks, acquirers and age-verification auditors are answered through [email protected].

Viewers are verified too. Every user is verified as an adult through our verification provider before any adult content is shown, in every country, as described in clause 7 of the Terms of Service. Adult content is never shown to unverified visitors.

Romanian law. CreamyPeach also complies with Law no. 196/2003 on preventing and combating pornography, which requires adult content to be made available only to adults and only on request, with a prior warning, and which prohibits any such material involving minors.

Reporting a concern. If you believe that any person depicted on the Platform is under 18, or did not consent, report it immediately through the "Report content" tool or to [email protected]. Reports about minors are escalated within one hour and the content is removed while we investigate.
